Description:In times of great financial distress and widespread political turmoil, some argue that developing countries are facing a disproportionate number of investment claims. Others note that investors lose the majority of cases or are awarded considerably less than they claim. Objectively speaking, the number of investment disputes have consistently grown over the past 10 years. Some of these cases settle, others take years to resolve, and on the whole, important government resources are spent on legal battles and compensation payments. The purpose of this panel event during the World Bank Annual meeting, is to highlight current investment arbitration trends in developing countries. The discussion will focus on whether the host states' level of development affects the international law standards of full protection and security; and fair and equitable treatment. |
