Technical
Assistance
Overview
In
addition to its training courses in Kampala, ILI-ACLE
furthers its goal of promoting legal, judicial and
economic reform in sub-Saharan Africa by providing
technical assistance or advisory services on issues
related to promoting private sector development and
good governance. A few of these technical assistance assignments
are listed below:
Common
Market for Eastern and Southern Africa (COMESA) Enhanced
Procurement Reform Capacity Project (EPRCP) (2007-2010)
This
year ILI-ACLE bid for and was awarded a three-year
project to consolidate reforms that were initiated
under the Public Procurement Reform Project (PPRP).
The EPRCP is crucial as it builds on the PPRP which
resulted in the adoption of procurement directives
developed by ILI-ACLE. The EPRCP will involve assessing
the levels of implementation of these directives and
diagnostic studies in selected COMESA member states
will be carried out to assess capacity building needs.
This information will form the basis of the development
of training systems which will be used in procurement
seminars across COMESA, as well as targeting the private
sector across the COMESA member states.
Rwanda
Commercial Law Reform Project (2006-2007) Following
a process of international competitive bidding in which
ILI-ACLE was the only short-listed African firm, ILI-ACLE
was invited for negotiations and awarded a contract
by the Government of Rwanda to reform the country’s
commercial laws. ILI-ACLE is in the process of reforming
16 pieces of legislation and submitting them in both
French and English. Project
on Strengthening Competitiveness of Private Enterprise (SCOPE)
(2005)
In
2005, under a contract between ILI-ACLE and Chemonics,
the ILI-ACLE undertook a study to benchmark Uganda’s
ability to take advantage of trade agreements with
the view of increasing Uganda’s competitiveness
and maximizing the benefits of these important bilateral
and multilateral agreements. The assignment was supported
by SCOPE’s
efforts to ensure Private Sector understanding of
the WTO framework against which all other regional
trade agreements are drawn; and in particular ensured
Uganda’s
strategic involvement in ACP-EU, COMESA, AGOA, and
the EAC agreements. Under the project, ILI-ACLE prepared
a comprehensive report detailing areas under which
Uganda could increase her trade competitiveness.
USAID
Global Competitiveness Hub Project (2004-2008) Under
a sub-contract between ILI and Bearing Point, USA,
ILI-ACLE provides broad training and technical assistance
to participants from 18 countries covered under the
project in subjects such as Multilateral and Regional
Trade Policy (including WTO accession); the COMESA
Free Trade Area, its Common External Tariff Negotiations;
and Corruption training (including the establishment
of an ethics legal framework in key public sector institutions
in five Northern Corridor Countries.) The project falls
under the auspices of the U.S. Government’s
Trade for African Development and Enterprise Initiative
and seeks to mobilize U.S. and African partners from
the public and private sector to support specific trade
capacity building needs. Under the project, ILI-ACLE
has carried out a number of trade seminars in Uganda
and Addis Ababa for beneficiary countries of the project.
COMESA
Public Procurement Reform Project (2002-2004)
In
a precedent-setting project, following international
competitive bidding, ILI-ACLE provided technical assistance
and training to the member states of COMESA for the
reform and harmonization of public procurement standards
in the COMESA region. ILI-ACLE drafted a harmonized
procurement directive for COMESA which was endorsed
by the COMESA Council of Ministers sitting in Khartoum
in 2003. This was the first comprehensive project linking
procurement in member states of COMESA to promoting
trade and investment in the 20-country trading bloc.
ILI-ACLE provided remote location training to senior-level
public officials from COMESA and its member states
in Lusaka, Zambia, Antanarivo, Madagascar, and Kampala,
Uganda in areas of public procurement reform and training
of trainers. Funding was provided by the African Development
Bank.
COMESA
Public Procurement Information System (CPIS) (2002-2004)
Following successful completion of the
African Development Bank-funded COMESA's multiyear Public
Procurement Reform Project of which ILI-ACLE was the
prime contractor, the Institute's mandate was extended
to provide further training and technical assistance
to develop the CPIS through additional technological
innovation, with the ultimate objective to develop modern
information communications technology that will drive
an effective and transparent public procurement process
within the COMESA region.
Modernization of Public Procurement
in Rwanda (2000)
Funded by the World Bank, this project
aimed at modernizing the Rwandese public procurement
system with a view to improving efficiency, economy,
and transparency of procurement. Services included review
and finalization of the draft law establishing the National
Tender Board and Regulatory Decree, preparation of implementing
procurement regulations, preparation of Standard Bidding
Documents, and identification of other aspects of the
procurement-related legal framework for possible review
and modernization.
Uganda Commercial Court Project (1998)
This technical assistance assignement
at the Uganda Commercial Court (UCC) examined issues
such as jurisdiction and composition of the UCC, case
management, procedures, court facilities, alternate dispute
resolution, and training. The project was funded by teh
Danish International Development Agency.
